CONDITIONS OF PURCHASE
GENERAL TERMS AND CONDITIONS
PURPOSE:
The purpose of these General Terms and Conditions is to regulate the relationship between Hoteles y Termas S.A. and the User (hereinafter the Customer), relating to all transactions carried out over the website www.la-perla.net (hereinafter the website), a domain owned by Hoteles y Termas S.A., a legally incorporated company with tax identification number A20500310.
ACCEPTANCE AND PROOF OF ACCEPTANCE
The validation of the order on behalf of the user means that the user explicitly declares his/her knowledge of the hereby Conditions of Purchase and the acceptance thereof as the text for the execution of the purchase-sale contract. In the absence of proof to the contrary, the data recorded by Hoteles y Termas S.A. shall be considered as proof of all the transactions carried out between the managers of Hoteles y Termas S.A. and the potential customers.
Once the order process has been carried out, and as soon as possible, Hoteles y Termas S.A. shall send the user an order and purchase receipt, which shall be sent to the e-mail address provided by the user at the time of registration and identification in Hoteles y Termas S.A..
PRICES, PAYMENT METHOD AND DELIVERY
Prices
Prices applicable to each product are those indicated on the website on the date of the order including Value Added Tax (VAT). However, the transaction may be exempt or non-taxable depending on the country of residence of the purchaser as well as the status of the purchaser (entrepreneur/professional or private individual). Consequently, in some cases the final price of the order may be altered from that shown on the website. The corresponding VAT will always be indicated on the order.
Quotations shall be duly marked and identified as such, indicating the previous price and the price of the quotation.
Hoteles y Termas S.A. reserves the right to modify its website at any time and without prior notice, and may update products and services according to the market.
Shipping costs.
Shipping costs will be displayed separately when viewing the linked screen from “view my shopping cart”, this cost will be added to the final price of the items selected through the Hoteles y Termas S.A. website.
Payment method
Purchases depending on the products to be purchased can be paid for using the following method:
- Payment by VISA or MASTERCARD
Payment made by means of VISA or MASTERCARD will be made in accordance with the requirements and protocols established by the issuing entity of the corresponding credit card, and payment will be made in accordance with the conditions established by the aforementioned entity.
In the event that the system reports that the card has been refused, the order will be automatically cancelled and the customer will be informed of said cancellation online.
Those responsible for Hoteles y Termas S.A. shall not be held responsible for any contingency that may occur in the process of payment made by means of credit card, and which is derived from the requirements established by the issuing entity of said credit card, or from the non-fulfilment of the requirements established by the international regulations on the Security of Electronic Commerce. In the event that the customer is still interested in purchasing the articles, he/she may proceed to pay for them using any other of the means of payment provided for and referred to in this clause.
Delivery
The selection of products offered by Hoteles y Termas S.A. is valid as long as the products are visible on the website and within the limits of available stock.
Once the order process has been carried out, and as soon as possible, Hoteles y Termas S.A. shall send the user an order and purchase receipt, which shall be sent to the e-mail address provided by the user at the time of registration and identification in Hoteles y Termas S.A..
Within a maximum of 7 days, your purchase will be prepared and sent by courier to the delivery address you have provided. This delivery will include the redeemable voucher(s) indicated as “voucher for service purchased”. The card/s received “voucher/s for service purchased” will be handed in at reception as proof of payment.
If, for any reason incumbent upon us, we are unable to meet the delivery date, we will contact the User to inform him/her of this circumstance and he/she may choose to continue with the purchase by setting a new delivery date or cancel the order with a full refund of the amount paid. In any case, home deliveries are made on working days.
If it is impossible to deliver the order due to the User’s absence, the order may be returned to the Carrier’s premises. However, the latter would leave a notice explaining where the order is and how to have it redelivered.
If the Customer does not receive the order within the established timeframe, or if it does not correspond to the service ordered, he/she may contact Hoteles y Termas S.A. by e-mail at ventas@la-perla.net
In any case, a delay in delivery, in accordance with the deadlines indicated, shall not entitle the customer to claim any liability and/or compensation whatsoever.
In the event that the customer detects any problem at the time of delivery of his/her order, he/she must indicate it in writing on the delivery note provided by the carrier, and notify Hoteles y Termas S.A. of said circumstance by sending an e-mail to the following address: ventas@la-perla.net, indicating the order reference and number in the subject line. All of the above within 24 hours of receipt at the latest.
No returns will be accepted for damaged or defective items, nor will any claims be accepted for missing items, if the customer has not notified us of this circumstance within the period established for this purpose.
DISMISSAL
To return the product, the customer must send an e-mail to the Customer Service Department, ventas@la-perla.net and wait for the instructions that will be sent to his/her e-mail address. The time limit for exercising the right of dismissal will be 14 days from receipt of the goods.
In any case, the user will be responsible for the shipping costs involved in returning the goods, unless the reason for the return is due to a defect or mistake in the goods or service purchased.
The refund of the amounts paid by the customer will be made through the means of payment used by the customer in the purchase.
Those responsible for Hoteles y Termas S.A. shall reimburse the customer the price of the product once the article to be returned has been received within the established time limits and the condition of the product to be returned has been checked.
USE OF THE SERVICE
In order to enjoy the purchased service, it is necessary to make a reservation. To make a reservation, please call us by phone: 943 45 88 56.
The “purchased service voucher” is transferable to third parties, and its presentation is sufficient for its use.
In order to make any change, the maximum period shall be three months from the date of purchase, it being necessary to present the purchase receipt as well as the “purchased service voucher”, which must be included in the package received by the customer.
The “purchased service voucher” has an expiry date of three years.
If the service booked by the customer is cancelled at any time, he/she must give at least one day’s notice prior to the date of booking in order to arrange a new date for the use of the service.

REQUIREMENTS OF THE SERVICE
In order to purchase the requested services, it is necessary to fill in the purchase form with personal data and payment details.
Once a Purchase Order has been received, Hoteles y Termas S.A. will immediately send a confirmation of the purchase to the e-mail address indicated in the Purchase Order, which will be deemed to have been accepted by the Customer in order to conclude the purchase.
RESPONSIBILITIES OF HOTELES Y TERMAS S.A.
Hoteles y Termas S.A. hereby guarantees the quality of the service requested through this web page.
Failure to comply with any of these General Terms and Conditions entitles the Customer to cancellation of the services purchased by the Customer.
RESPONSIBILITIES OF THE CUSTOMER
The Customer undertakes to make lawful use of the services, without contravening current legislation or violating the rights and interests of third parties.
The Customer guarantees the truthfulness and accuracy of the data provided when filling in the purchase forms, avoiding any damage caused to Hoteles y Termas S.A. as a result of the inaccuracy of such data.
The breach of any of these Conditions may lead to the withdrawal or cancellation of the services by Hoteles y Termas S.A., without the need to give prior notice to the Customer and without entitlement to any compensation whatsoever.
INDUSTRIAL AND INTELLECTUAL PROPERTY
The intellectual and industrial property rights over brands, logos and any other subject of protection contained in the web page of Hoteles y Termas S.A. correspond exclusively to Hoteles y Termas S.A. or to third parties who have authorised their inclusion in the web page. The unauthorised reproduction, distribution, commercialisation or transformation of such works, brands, logos, etc. represents an infringement of the intellectual and industrial property rights of Hoteles y Termas S.A. or of the owner thereof, and may be subject to the exercise of any judicial or extrajudicial actions that may correspond to them in the exercise of their rights.
Likewise, the information to which the Customer may have access through the website may be protected by industrial, intellectual or other property rights. Hoteles y Termas S.A. will not be liable in any case and under no circumstances for any infringement of such rights that you may commit as a user.
JURISDICTION AND GOVERNING LAW
In the event of any conflict or discrepancy emerging in the interpretation or application of these contractual conditions, the Courts and Tribunals which, where applicable, shall hear the matter, will be those established by the applicable legal regulations regarding applicable jurisdiction, in which, in the case of end consumers, the place of execution of the obligation or the place of residence of the purchasing party shall be taken into account.
COMPLAINTS AND CLAIMS
The User may send to Hoteles y Termas S.A. his/her complaints, claims or any other comment he/she may wish to make through the contact details provided at the beginning of these Terms and Conditions.
Furthermore, Hoteles y Termas S.A. has official complaint forms available to consumers and users, whom may request such forms from Hoteles y Termas S.A. at any time, using the contact details provided at the beginning of these Terms and Conditions (General Information).
Likewise, should a dispute arise from the conclusion of this purchase contract between Hoteles y Termas S.A. and the User, the User as a consumer may request an out-of-court settlement of disputes, in accordance with EU Regulation No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on the settlement of consumer disputes online and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC.
